Art by Innovation publishes work by more than one artist. Copyright in a piece of artwork belongs to the person who made it — not to this site, and not to whoever downloads it.

Most of the catalog is original work created by Jeff Dupler, much of it made with AI tools — Flux.1, ComfyUI, MidJourney and related software — followed by human curation, retouching, and finishing in Photoshop. Some of it is not made with AI at all, including every icon and interface piece on this site. Jeff Dupler is the copyright holder of that work. Viewing, downloading, or reposting an image does not transfer copyright, and no license beyond the ones described below is granted at any time.
Artwork by artist members
Artists keep the copyright in everything they publish here. Art by Innovation does not acquire ownership of an artist’s work and does not claim it. Publishing through this site grants us a non-exclusive license to do only what hosting requires: store the file, produce the resized and watermarked versions the galleries need, display it on the site with the artist’s credit, and show a thumbnail of it when we are promoting that artist or the gallery it sits in. Nothing beyond that, and nothing exclusive.
An artist decides, gallery by gallery, whether their work appears in the free galleries only or is also included in the paid tiers. Where a gallery is included in the paid tiers, MEMBERS-1.0 governs the files members download from it, exactly as it does for our own work. Where it is not, the work stays in the free galleries under PUBLIC-1.0 and is never sold.
All work is reviewed before it is published, and must follow our content rating rules — every gallery on this site is rated PG-13. Art by Innovation decides whether a piece meets that standard and may move it to a gallery that fits, or decline it. That is a placement decision only — we do not alter the image itself to fit the rating, and declining a piece takes no rights in it. It remains the artist’s work.
An artist may withdraw their work at any time, or close their account, and we stop displaying and distributing it. Anyone who bought or downloaded a file before it was withdrawn keeps the license they were granted for that file. We cannot recall a file that has already left the site, and we will not claim otherwise.
The site itself
The Art by Innovation name and logo, the site design, its written text, and its code are © Jeff Dupler / Art by Innovation, all rights reserved. That is separate from the artwork, and an artist’s rights in their own work are unaffected by it.
Which license applies
Two licenses govern the artwork, whoever made it, depending on which tier a file came from:
- Public Gallery Images — PUBLIC-1.0. Watermarked previews. Personal use, and reposting permitted with visible author credit. Resale prohibited.
- Members Gallery Images — MEMBERS-1.0. Clean high-resolution files for active members. Strictly personal use. Redistribution and resale prohibited.
Both licenses run in favor of whoever holds the copyright in that particular image. A plain-language summary of both is also available.
Embedded copyright metadata
Every file we publish carries its copyright information inside the file itself — the creator, the copyright notice, the rights statement, and a link back to the license that governs it. On an artist’s work, the creator named in that metadata is the artist, not this site. Removing or altering embedded metadata, like removing a watermark, is a violation of the license and, in many jurisdictions, of copyright management information law.
AI training
No image on this site may be used to train, fine-tune, or otherwise condition any machine learning model or dataset without prior written permission from the copyright holder. This applies to every tier, including the watermarked public previews, and it applies to automated collection as much as to manual downloading. It applies to artists’ work as fully as to our own, and no artist is asked to waive it as a condition of publishing here.
Reporting infringement
If you believe your work has been infringed by material on this site — including by something another artist has published here — send a notice to [email protected] including: identification of the work, the URL of the material you are complaining about, your contact details, a statement of good-faith belief that the use is unauthorized, a statement under penalty of perjury that the notice is accurate and that you are authorized to act, and your signature. We respond to complete notices promptly.
If you find artwork from this site being used elsewhere in breach of these terms, we would be glad to hear about it at the same address, whether the work is ours or an artist’s.
