These Terms & Conditions (“Terms”) govern your use of the Art by Innovation website at https://www.artbyinnovation.com and all purchases made through the site. By using the site or making a purchase, you agree to these Terms in full.
1. About Us
Art by Innovation is owned and operated by Jeff Dupler. The artwork on this site is created by Jeff Dupler, much of it using tools including Flux.1, ComfyUI and MidJourney and finished by hand in Photoshop, and some of it without AI tools at all. All of it is protected by applicable copyright law.
2. Age Requirement
You must be at least 18 years of age to use this site, create an account, or make a purchase. By using the site, you confirm that you meet this requirement.
3. Digital Downloads — License
Store purchases. When you buy a digital artwork in the Store, you receive a perpetual, worldwide, non-exclusive, royalty-free license to use that image for personal and commercial purposes: print it, publish it, put it on a product, use it in a client project or in advertising, modify it and build on it. No attribution is required and there are no per-use fees. The license does not transfer copyright ownership. The Store sells only artwork created by Jeff Dupler; work published by artist members is never sold in the Store.
Under a Store license you may not:
- Resell, sublicense, or redistribute the image file itself — as stock, in a template or asset pack, in an NFT, or in any form where the image is what the buyer is acquiring.
- Upload or share the files on stock sites or public repositories.
- Use the artwork to train, fine-tune, or otherwise condition any machine learning model or dataset.
- Claim to own the copyright in the artwork.
Member downloads. Files downloaded through a membership are licensed for personal, non-commercial use only, under the Members license described on our Licensing page. Watermarks and credits on public gallery images must stay in place.

4. Memberships
A free Watcher account and the paid Member Monthly and Member Annual plans provide access to member content and features according to the plan selected. Paid membership fees are billed on a recurring basis and may be canceled at any time from your account dashboard. See our Refund Policy for details on cancellations and billing.
5. Artist Accounts
Every artwork on this site today is created by Jeff Dupler. Art by Innovation does not sell, license or distribute work by anyone else.
Accounts for other artists to publish their own work here are planned. Before they open, the full terms for artists — copyright, what an artist grants us to host the work, withdrawal, review and content rating — will be published in this section, and these Terms will be updated with a new date. Artists will always keep the copyright in their own work, and their work will never be sold in the Store.
6. AI Disclosure
Much of the artwork on this site is made using artificial intelligence tools under the creative direction of the artist, and some is made without them. Art by Innovation makes no representations about the eligibility of AI-assisted works for copyright registration in any jurisdiction, and buyers accept the artwork “as is” with respect to the evolving legal landscape around AI art ownership.
7. Payments
All payments are processed securely through Stripe. Art by Innovation does not store your credit card information. By completing a purchase, you authorize the charge to your payment method for the amount shown at checkout.
8. Intellectual Property
The Art by Innovation name and logo are trademarks of Jeff Dupler. The site design, its code, and the text written by or for Art by Innovation are © Jeff Dupler / Art by Innovation, as is the artwork created by Jeff Dupler.
Except as expressly permitted by the licenses that govern the artwork — PUBLIC-1.0 and MEMBERS-1.0, summarized in plain language at Licensing — it must not be reproduced, distributed, or used to train a machine learning model without written permission. Where those licenses grant you a right, this section does not take it away.
Artwork published by artist members remains the copyright of those artists, as does the text they supply with it — their bio, their gallery descriptions and titles. Section 5 (Artwork Published by Artist Members) governs it. Comments, messages, and other material submitted by members likewise remain theirs.
Product names, trademarks, and software referred to on this site are the property of their respective owners.
9. Prohibited Conduct
You agree not to:
- Use the site for any unlawful purpose.
- Attempt to gain unauthorized access to any part of the site or its infrastructure.
- Scrape, harvest, or systematically download site content.
- Circumvent any access controls, DRM, or download protections.
- Harass other members or site staff.
10. Disclaimer of Warranties
The site and all digital products are provided “as is” without warranty of any kind. Art by Innovation does not warrant that the site will be uninterrupted, error-free, or free of viruses. Your use of the site is at your own risk.
11. Limitation of Liability
To the fullest extent permitted by law, Art by Innovation shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the site or purchase of products, even if advised of the possibility of such damages.
12. Governing Law
These Terms are governed by the laws of the State of Ohio, United States, without regard to conflict of law principles.
13. Changes to These Terms
We reserve the right to update these Terms at any time. Continued use of the site after changes are posted constitutes acceptance of the revised Terms.
