These Terms & Conditions (“Terms”) govern your use of the Art by Innovation website at https://www.artbyinnovation.com and all purchases made through the site. By using the site or making a purchase, you agree to these Terms in full.

1. About Us

Art by Innovation is owned and operated by Jeff Dupler. All AI-generated artwork on this site is created by Jeff Dupler using tools including Flux.1, ComfyUI, and Stable Diffusion, and is protected by applicable copyright law.

2. Age Requirement

You must be at least 18 years of age to use this site, create an account, or make a purchase. By using the site, you confirm that you meet this requirement.

3. Digital Downloads — License

When you purchase a digital artwork download, you receive a non-exclusive, non-transferable personal license to use the files for personal, non-commercial purposes only. This license does not transfer copyright ownership.

Unless you have purchased a commercial license, you may not:

  • Resell, redistribute, or sublicense the files.
  • Use the artwork in commercial products, merchandise, NFTs, or advertising.
  • Claim the artwork as your own or remove watermarks or credits.
  • Upload or share the files on stock sites or public repositories.

4. Memberships

Membership plans (Watcher, Member, Collector) provide access to member-only content and features according to the plan selected. Membership fees are billed on a recurring basis and may be cancelled at any time from your account dashboard. See our Refund Policy for details on cancellations and billing.

5. AI-Generated Art Disclosure

All artwork on this site is generated using artificial intelligence tools under the creative direction of Jeff Dupler. Art by Innovation makes no representations about the eligibility of AI-generated works for copyright registration in any jurisdiction, and buyers accept the artwork “as is” with respect to any evolving legal landscape around AI art ownership.

6. Payments

All payments are processed securely through Stripe. Art by Innovation does not store your credit card information. By completing a purchase, you authorize the charge to your payment method for the amount shown at checkout.

7. Intellectual Property

All site content including artwork, text, logos, and design is the property of Jeff Dupler / Art by Innovation and may not be reproduced without express written permission. The Art by Innovation name and logo are trademarks of Jeff Dupler.

8. Prohibited Conduct

You agree not to:

  • Use the site for any unlawful purpose.
  • Attempt to gain unauthorized access to any part of the site or its infrastructure.
  • Scrape, harvest, or systematically download site content.
  • Circumvent any access controls, DRM, or download protections.
  • Harass other members or site staff.
